What this amendment would do
SA 4271, submitted by Mr. Bennet, aims to add Section 239 to bill H.R. 7148. The purpose is to require the Secretary of Homeland Security to provide all Members of Congress with unrestricted access to all immigration detention facilities used or operated by the Department of Homeland Security without advance notice.
This includes facilities that are:
- ICE-operated
- State-run
- Privately operated or contracted
This access must include the ability to enter all areas of the facilities, speak privately with personnel and detained individuals, and observe confinement conditions and compliance with Federal law, regulations, and standards.
The amendment specifies that facility operators cannot deny or restrict access based on:
- Security concerns
- Staffing limitations
- Operational considerations
- Contractual arrangements
- Facility designation
If a Member of Congress is denied or delayed in accessing a facility, the Secretary of Homeland Security must submit a detailed report within 24 hours to specific Senate and House committees. This report must identify the reasons for the delay or denial and describe steps to prevent it from happening again.
