What this amendment would do

SA 4266 is an amendment proposed by Mr. Bennet to H.R. 7148. Its purpose is to add a new section to the bill that establishes identification requirements for immigration enforcement personnel.

Changes and Additions

The amendment aims to add the following to the bill:

  • Identification Requirements: It requires covered immigration officers and supporting law enforcement officers conducting public-facing immigration enforcement functions to visibly display their last name, a unique individual identifier, the name of their employing organization, and their face.

  • Definitions: It defines "covered immigration officer" to include employees of U.S. Customs and Border Protection, U.S. Immigration and Customs Enforcement, and other individuals authorized to perform immigration enforcement functions. It also defines "immigration enforcement function" as public-facing actions like arrests, searches, raids, and checkpoints, while excluding covert operations.

  • Exceptions: The identification requirements do not apply to those using assumed names for investigations, personnel engaged in specific planned tactical operations for high-risk situations, or those performing functions that require face coverings under specific federal regulations.

  • Protections for Information: The amendment specifies that it cannot be used to stop the press from reporting on alleged misconduct of a covered employee, the disclosure of information regarding public concerns, or information voluntarily published on the internet by the employee or employer.

  • Privacy-Enhancing Services: It defines "privacy-enhancing services" as technological means to mitigate privacy risks from data processing by reducing or suppressing personal information for "covered employees," which includes the officer and certain family members who live with them.
