What this amendment would do

SA 4252 is an amendment submitted by Ms. Duckworth and others to be added to bill H.R. 7148. Its purpose is to require the Inspector General of the Department of Homeland Security to investigate use of force incidents during civil immigration or interior enforcement operations.

The amendment aims to add the following requirements:

  • The Inspector General must investigate all use of force incidents in these operations occurring since January 20, 2025, starting no later than 14 days after the Act is enacted.
  • Any future use of force incidents in these operations must also be investigated in a timely and independent manner.
  • The Inspector General must coordinate with other agencies, such as the Department of Justice, to assess if Federal employees followed laws and policies, evaluate training and oversight, and recommend corrective actions like policy reforms, discipline, or criminal prosecution referrals.
  • Coordination with State and local law enforcement is required, including sharing relevant information and evidence.
  • Results of each investigation must be published on a public website, including justifications for any referrals for civil penalties, adverse actions, or criminal prosecution.

The amendment also adds penalties if the Inspector General fails to start the investigations by the required date:

  • Daily in-person briefings for all Members of Congress and staff.
  • A ban on the Inspector General using annual or other leave.
  • A ban on using funds for the Inspector General's travel.
  • If investigations are not started within 30 days of enactment, the Inspector General will be placed in a temporary status without pay or duties until they are initiated.
