What this amendment would do
SA 4240, submitted by Mr. Kennedy, aims to add a new section (Section 5019A) to bill H.R. 7148. This addition requires a comprehensive review of the bilateral relationship between the United States and South Africa.
The amendment adds the following requirements:
-
Bilateral Review and Reporting: The President must conduct a review of the U.S.-South Africa relationship and submit a report to the House Committee on Foreign Affairs and the Senate Committee on Foreign Relations within 120 days. This includes a certification on whether South Africa has undermined U.S. national security or foreign policy interests.
-
Report on Sanctionable Persons: Within 120 days, the President must provide a classified report listing senior South African government officials and African National Congress leaders who have committed human rights abuses or corruption that meet Global Magnitsky Human Rights Accountability Act criteria. This report must include an explanation of the conduct and a timeline for sanctions or a justification for not imposing them.
-
Trade Preference Termination: If the President certifies that South Africa has undermined U.S. national security or foreign policy interests, the President must end South Africa's eligibility for certain trade programs under the Trade Act of 1974 and the African Growth and Opportunity Act.
