What this amendment would do

SA 4170, submitted by Mrs. Blackburn, aims to add a requirement for the Attorney General to report on Department of Justice activities used to counter national security threats and espionage from the Chinese Communist Party in the United States.

The amendment requires the following:

  • Reporting Schedule: A report must be submitted to the Senate and House Committees on the Judiciary and made public on the Department of Justice website within 90 days of the Act's enactment, and every year for the next 7 years.

  • Report Content: The report must include:

    • Descriptions of activities and operations, specifically regarding the theft of research and intellectual property (including trade secrets), and threats from non-traditional collectors like researchers at universities, laboratories, and defense industrial base facilities.
    • An accounting of Department of Justice resources dedicated to these programs and information on how effective each program is.
    • A detailed description of the measures taken to protect the privacy rights, civil liberties, and civil rights of United States persons.
  • Format and Collaboration: The report must be unclassified but can have a classified annex. The Attorney General must work with the Secretary of Defense, the Secretary of Homeland Security, the Director of National Intelligence, and other appropriate officials to prepare the report.
