What this amendment would do
As an analyst keeping an eye out for everyday folks, let us break down what Mr. Kaine is trying to do with this amendment. Simply put, it creates a new rule in the Senate to stop our elected officials from rushing through major changes to our healthcare without knowing the facts first.
What It Changes and Adds
-
Adds a Point of Order: It makes it out of order in the Senate to consider legislation that affects programs like Medicare, Medicaid, the Children's Health Insurance Program, the Affordable Care Act, or other health insurance laws for at least 1,000,000 people, unless a specific condition is met.
-
Requires CBO Estimates First: Before a final vote can happen on that kind of legislation, the Congressional Budget Office must have the required estimate available on its website for at least 72 hours.
-
Sets Waiver Rules: This new rule can only be waived or suspended in the Senate by a three-fifths vote of the members, and it also takes a three-fifths vote to override a ruling by the Chair.
-
Demands Coverage Impact Data: During the 119th Congress, estimates for significant legislation must include the expected impact on health insurance coverage in the United States for at least 1,000,000 people.
