What this amendment would do
SA 3993, submitted by Mr. Padilla, aims to limit how the President can use the National Guard for a specific federal protective mission.
-
The amendment proposes that the President cannot use section 12406 of title 10, United States Code, or any other law to call National Guard members into Federal service for the mission announced in the June 7, 2025, Presidential memorandum titled "Department of Defense Security for the Protection of Department of Homeland Security Functions."
-
There is one exception: this limit does not apply if the National Guard members are called into Federal service for a mission that happens entirely within their own State.
