What this amendment would do
SA 3992, submitted by Mr. Padilla, aims to add a section regarding congressional oversight of domestic use of the National Guard to bill H.R. 4016.
The purpose of this amendment is to require the President to submit a report to Congress within 15 days after deploying or using National Guard members within the United States. This requirement does not apply to deployments involving natural disasters or weather-related events under the Robert T. Stafford Disaster Relief and Emergency Assistance Act.
The report must include:
- The legal basis, goals, and evidence used by the President for the deployment.
- The effect of the deployment, including reports of interactions between National Guard members and civilians involved in violence or threats of violence.
- Reports from State and local law enforcement regarding those interactions and their assessment of whether the deployment was proper.
- The total cost to the Federal Government, including indirect costs from the Department of Defense.
- A certification that the use of the National Guard will not stop the Armed Forces from responding to disasters covered by the Robert T. Stafford Disaster Relief and Emergency Assistance Act.
