What this amendment would do

SA 3991, submitted by Mr. Padilla, is an amendment to be proposed to amendment SA 3951 and bill H.R. 4016.

The purpose of this amendment is to prohibit the President from using section 12406 of title 10, United States Code, or any other law to call National Guard members from any state other than California into Federal service.

This restriction applies specifically to the Federal protective mission announced in the June 7, 2025, Presidential Memorandum titled "Department of Defense Security for the Protection of Department of Homeland Security Functions."
