What this amendment would do
SA 3922, submitted by Mr. Heinrich, aims to add a section to the bill regarding multiyear procurement authority for ultra-high-purity nuclear-grade graphite.
The purpose of this amendment is to address the fact that the United States is 100 percent reliant on imports for graphite and that there are no domestic or allied sources of ultra-high-purity nuclear-grade graphite.
The amendment seeks to change the bill by adding the following:
- Procurement Requirements: The Secretary of Defense must enter into multiyear contracts to buy 1,500 metric tonnes of ultra-high-purity nuclear-grade graphite per year from the only known source in North America.
- Funding: It increases the amount authorized for purchases of strategic and critical materials under the Defense Production Act of 1950 by $60,000,000 to be used for this graphite.
- Contract Terms: The procurement cost is set at $60,000,000 per year. Payments for years after fiscal year 2026 depend on whether funds are available.
- Timeline: It authorizes advance procurement starting in fiscal year 2026. The "covered period" for these actions starts on the date the Act is enacted and lasts between 17 and 50 years.
