What this amendment would do
This amendment, submitted by Mr. Merkley and Mr. Wyden, aims to add a section titled Limitation on Use of Federal Law Enforcement Officers for Crowd Control to the bill. It is designed to set rules and restrictions for Federal law enforcement officers and members of the armed forces when they are handling crowd control, riots, or the arrest of people involved in protests and civil disobedience.
The amendment adds the following requirements and restrictions:
-
Identification: Officers and armed forces members must clearly display their agency and their last name or a unique identifier. They are prohibited from covering or hiding this information and cannot use unmarked vehicles to arrest or detain civilians.
-
Authority Limits: These officers and members are generally only authorized to perform crowd control or arrests on Federal property or in the immediate vicinity, such as adjacent sidewalks and streets. This is waived if the Governor of a State and a local government head both request support in writing, or if the Insurrection Act of 1807 is invoked.
-
Legal Restrictions: It is unlawful for these individuals to arrest someone if they are violating the identification or authority rules mentioned above.
-
Public Notice: Agencies must post a notice on their public website within 24 hours of deployment. This notice must include the date, the number of personnel in each locality, the mission description, where detained civilians are being held, and any written requests for assistance from state and local leaders.
