What this amendment would do

SA 3896, submitted by Mr. Booker and Mr. Blumenthal, aims to add Section 515 to the bill, which creates limitations on domestic deployments of National Guard members.

The amendment changes Section 12406 of title 10, United States Code, to add a notification requirement. Under these changes:

  • The President must notify Congress of a planned deployment no later than 24 hours before calling National Guard members and units into Federal service.

  • This notice must include a good-faith claim for federalizing the National Guard and provide specific descriptions of the following:

    • The invasion, including the foreign power, the territory, and the acts that make the authority necessary.
    • The rebellion, including the time, place, persons or groups involved, and the activities necessitating the authority.
    • The laws of the United States the President cannot execute, why regular military forces cannot execute them, and evidence of a Governor's refusal or inability to provide public safety, failure to obey a court order, or steps taken to obstruct the President.
    • The geographical area of the deployment and how long the federalization will last.
