What this amendment would do
SA 3885, submitted by Mr. Booker, aims to change the structure and oversight of the United States Marshals Service. The primary purpose is to establish the Service as a bureau within the judicial branch of the United States.
The amendment proposes the following changes:
-
Leadership and Appointments: The Chief Justice, in consultation with a new Board, would appoint the Director and the United States marshals for each judicial district and the Superior Court of the District of Columbia.
-
Oversight: A Board consisting of the Chief Justice, the Judicial Conference of the United States, and the Director (as a nonvoting member) would supervise the Director and set goals to improve the Service's efficiency and effectiveness.
-
Powers and Duties: The Service is authorized to provide personal protection for Federal jurists, court officers, witnesses, and other threatened persons.
-
Law Enforcement Assistance: The Service may assist the Department of Justice with specific tasks—such as investigating fugitive matters, investigating unregistered sex offenders via administrative subpoenas, and recovering missing children—provided the Attorney General requests it and the Director approves.
-
Administrative Shifts: The amendment moves the Service's legal designation (chapter 37 to chapter 59) within Title 28 of the United States Code to place it under part III.
