What this amendment would do
SA 3883, submitted by Mr. Booker, aims to eliminate increased penalties for cocaine offenses specifically when the cocaine involved is cocaine base.
To achieve this, the amendment proposes to add a section to S. 2296 that repeals specific provisions within the Controlled Substances Act and the Controlled Substances Import and Export Act.
The amendment also addresses how these changes apply to different cases:
-
Pending cases: The changes apply to any sentence imposed after the date the Act is enacted, no matter when the offense happened.
-
Past cases: For those convicted or sentenced before the Act's enactment for a Federal offense involving cocaine base, the sentencing court can impose a reduced sentence. This can happen via a motion from the defendant, the Bureau of Prisons, the government attorney, or the court itself, after considering factors in section 3553(a) of title 18, United States Code.
