What this amendment would do
This amendment, submitted by Mr. Merkley, aims to add a new section (Section 1248) to bill S. 2296. Its purpose is to deny entry into the United States for current or former foreign government officials who are determined by the Secretary of State to be responsible for or complicit in the forced repatriation to the People's Republic of China of Uyghurs or members of other ethnic and religious groups who are likely to face persecution.
Key Changes and Additions:
-
Entry Restrictions: It makes these officials inadmissible to the U.S., ineligible for visas or other entry documentation, and ineligible for benefits under the Immigration and Nationality Act.
-
Visa Revocation: It requires the immediate revocation of any existing visas or entry documentation held by these officials.
-
Waivers and Exceptions: The Secretary of State can grant a waiver if it is in the national interest or if circumstances have changed. An exception exists for admissions necessary to comply with international obligations, such as the Agreement regarding the Headquarters of the United Nations.
-
Enforcement and Reporting: The President may use authorities from the International Emergency Economic Powers Act to carry out the section, and penalties may apply to foreign persons who violate these rules. The Secretary of State must provide reports to specific House and Senate committees every 180 days listing affected officials and any waivers granted.
-
Duration: This section is set to terminate 5 years after the Act is enacted.
