What this amendment would do

SA 3850 is an amendment proposed by Mr. Cassidy and Mr. Whitehouse to be added to bill S. 2296. Its purpose is to establish the public disclosure of vehicle and aircraft manifest information by amending Section 431 of the Tariff Act of 1930.

The amendment aims to change and add the following:

  • Manifest Requirements: It expands the requirement for manifests to include every commercial vehicle arriving in or departing from the United States that transports merchandise for exportation or importation and must transmit advance electronic information.

  • Public Disclosure: It specifies that information in vessel, vehicle, or aircraft manifests shall be available for public disclosure. For vehicles, this includes the port of entry. For vessels or aircraft, it includes the seaport or airport of loading and discharge.

  • Privacy Protections: It requires the Secretary to remove personally identifiable information before public access, such as:

    • Social Security numbers.
    • Passport numbers.
    • Names of individuals who are end consumers.
    • Residential addresses (excluding zip codes) that are not primary business addresses.
    • The amendment notes that business names, addresses, or identification numbers cannot be removed.
  • Processing: For vehicles departing the United States, U.S. Customs and Border Protection must process the manifest via the Automated Commercial Environment system and provide the allowable information to appropriate parties.

  • Timeline: These changes apply to vessels, vehicles, and aircraft arriving in or departing from the U.S. starting 120 days after the Act is enacted.
