What this amendment would do
SA 3807, submitted by Mr. Markey, aims to add a new section (SEC. 3119) to bill S. 2296. The purpose of this amendment is to limit the transfer of weapons-grade plutonium to private industry.
-
Funding Restrictions: It prohibits using funds from fiscal year 2026 for the Departments of Defense or Energy to transfer plutonium to private industry.
-
Program Requirements: The surplus plutonium dilute and dispose program cannot be ended until the Secretary of Defense and the Secretary of Energy provide a report to congressional defense committees.
-
Report Details: The required report must include:
- How the Trump administration will discourage countries of proliferation concern from extracting weapons-usable plutonium from civilian fuel if the U.S. does so.
- Justification for the Federal Government facilitating the export and development of proliferation-prone reprocessing technologies by private companies.
- Justification for promoting a technology that makes U.S. nuclear energy less economically competitive due to high safety and security costs that increase fuel costs by 10 times or more.
- A full accounting of weapons plutonium parts being transferred or disassembled, including the amount coming from intact pits, the types of pits used, and the impact on reusing pits or producing new ones at Los Alamos National Laboratory.
-
Format: The report must be unclassified but can have a classified annex.
