What this amendment would do

This amendment, submitted by Ms. Cortez Masto, is about keeping our elected officials accountable when it comes to healthcare, specifically Medicaid. The purpose of this amendment is to add a new rule in the Senate that makes it out of order to consider legislation that puts States in a position to reduce Medicaid eligibility, limit coverage of certain services, or reduce provider payment rates.

To change or add to the bill, this amendment introduces a specific point of order against reducing provider participation in Medicaid. Under this new rule, any bill, joint resolution, motion, amendment, amendment between the Houses, or conference report that leads to these reductions can be challenged.

  • Protections included: Stops actions that reduce Medicaid eligibility.
  • Coverage protections: Stops actions that limit coverage of certain services.
  • Payment protections: Stops actions that reduce provider payment rates.

If someone wants to bypass this rule and pass a measure that does these things, it would take a three-fifths affirmative vote of the Senators chosen and sworn to waive or suspend the rule, or to sustain an appeal of the ruling of the Chair.
