What this amendment would do

This amendment, submitted by Mr. Cassidy and Mr. Whitehouse, aims to change the Tariff Act of 1930 regarding the public disclosure of manifest information.

The purpose of the amendment is to:

  • Expand Manifest Requirements: It adds commercial vehicles transporting merchandise for importation into or exportation from the United States (that are required to transmit advance electronic information) to the list of entities that must have a manifest.

  • Update Disclosure Rules: It updates the language to ensure that information from vessels, vehicles, or aircraft is available for public disclosure.

  • Protect Personal Privacy: It requires the Secretary to remove personally identifiable information before public access, specifically:

    • Social Security numbers.
    • Passport numbers.
    • Names of individuals who are end consumers.
    • Residential addresses that are not primary business addresses (though zip codes are excluded from this removal).
  • Maintain Business Transparency: It states that the name, address, or identification number of a business cannot be removed from the manifest.

  • Coordinate Data Processing: It requires U.S. Customs and Border Protection to process manifests for departing vehicles provided to the Automated Commercial Environment system and provide the allowed information to appropriate parties.
