What this amendment would do

SA 3773, submitted by Mr. Durbin and Ms. Duckworth, is an amendment to bill S. 2296. This bill deals with appropriations for fiscal year 2026 regarding the Department of Defense, military construction, and Department of Energy defense activities.

The purpose of this amendment is to add a new section called "Requirement for State Consent for Title 32 Deployments."

It aims to change how funds are used by adding the following requirement:

  • The Department of Defense cannot use funds from the Act for National Guard deployments under title 32 in any State or Federal territory unless the chief executive of that State or territory has consented to the deployment.
