What this amendment would do
SA 3719 is an amendment proposed by Mr. Cassidy and Mr. Whitehouse to be added to bill S. 2296. Its purpose is to establish rules for the public disclosure of vehicle and aircraft manifest information.
The amendment aims to change and add the following to the Tariff Act of 1930:
-
Manifest Requirements: It expands manifest requirements to include every commercial vehicle arriving in or departing from the United States that transports merchandise for importation or exportation and is required to send advance electronic information.
-
Public Disclosure: It updates the law to ensure certain information from vessel, vehicle, or aircraft manifests is available for public disclosure.
-
Privacy Protections: It requires the Secretary to remove personally identifiable information before public access, including:
- Social Security numbers.
- Passport numbers.
- Names of individuals who are end consumers.
- Residential addresses that are not primary business addresses (though zip codes may remain).
- Note: Business names, addresses, or identification numbers cannot be removed.
-
Processing: It directs U.S. Customs and Border Protection to process manifests for departing vehicles provided to the Automated Commercial Environment system and provide the allowed information to the appropriate parties.
-
Bond Requirement: It adds a requirement for each vehicle arriving in the United States that needs a manifest to post a bond to ensure they comply.
-
Timeline: These changes apply to vessels, vehicles, and aircraft arriving in or departing from the U.S. starting 120 days after the Act is enacted.
