What this amendment would do
This amendment, submitted by Mr. Kennedy, aims to improve coordination between federal and state agencies and the Do Not Pay working system. It proposes changes to the Social Security Act to help prevent improper payments and support the recovery of benefits or payments that were paid improperly.
The amendment adds or changes the following:

It requires the Commissioner of Social Security to provide information to the agency operating the Do Not Pay working system through a cooperative arrangement, as long as certain requirements are met.
-
It requires the Commissioner of Social Security and the agency operating the Do Not Pay working system to enter into an agreement regarding the proportional share of State death data costs.
-
It prohibits the Commissioner of Social Security from recording a death to a record unless there is clear and convincing evidence that the individual should be presumed deceased.
-
It requires notification to any agency with a cooperative arrangement if there is an error regarding individuals incorrectly identified as deceased.
