What this amendment would do

SA 3694, submitted by Mr. KIM, aims to add Section 1067 to the bill. Its purpose is to regulate and ensure access to counsel for aliens detained by the Government on Department of Defense installations.

The amendment seeks to change or add the following:

  • Counsel Access: The Secretary of Defense must ensure prompt access to counsel, cannot require prior notification of intent to visit, and must provide a private location within the detention facility for discussing sensitive information. The Secretary may request information necessary for counsel to enter and exit without delay.

  • Emergency Limits: The Secretary of Defense and Secretary of Homeland Security may limit counsel access during an emergency.

  • Record Keeping: The Secretary of Homeland Security and Secretary of Defense must maintain records of counsel seeking access, including names, installations, arrival times, entry times, and justifications for any denials. These records must be made public daily on a Department of Homeland Security website.

  • Alternative Communication: If physical visits are not possible, the Secretary of Defense must provide other ways for counsel and the alien to communicate, such as video teleconference, telephone, or teleconference.

  • Program Funding: The Attorney General must restore funding and operations for specific Executive Office for Immigration Review programs, including:

  • The immigration court help desk.

  • The legal orientation program for detained adults.

  • Family group legal orientation.

  • The counsel for children initiative.
