What this amendment would do
This amendment, submitted by Mr. Markey, aims to reauthorize and enhance the Small Business Innovation Research (SBIR) and Small Business Technology Transfer (STTR) programs. Its primary purpose is to extend the legal authority of these programs and various related pilot programs through September 30, 2030.
The amendment seeks to change or add the following to the bill:
Program Extensions and Funding
- Extends the authority for SBIR, STTR, and the FAST program.
- Increases the required agency expenditures for these programs on a sliding scale from 2026 through 2032.
- Expands the Direct to Phase II authority to all Federal agencies required to carry out an SBIR program.
Increasing Competition and Participation
- Creates fellowship and internship opportunities for students and postdocs, with a requirement for enhanced outreach to women, socially disadvantaged, and economically disadvantaged individuals.
- Requires enhanced outreach to individuals at minority institutions and Hispanic-serving institutions.
- Provides assistance to small businesses applying for programs to increase participation from States that have historically received fewer awards.
Commercialization and Technical Support
- Establishes a Technology Commercialization Official in each participating Federal agency to guide awardees in transitioning technologies to the market.
- Implements training for the agency acquisition workforce regarding Phase III acquisitions.
- Improves technical and business assistance by allowing recipients to select their own vendors and use funds to hire or train staff.
- Mandates a Commercialization Impact Assessment to measure the success of businesses that have received 50 or more Phase II awards.
Oversight and Security
- Requires the Comptroller General to report on the effectiveness of these programs regarding diversification and commercialization.
- Updates reporting requirements to include more data on subcontracted research institutions on agency websites.
- Codifies safeguards to make small businesses ineligible for awards if they are owned and controlled in majority part by a covered foreign entity.
