What this amendment would do

This amendment, submitted by Mr. Risch, aims to add a new section called Artificial Intelligence Diplomacy to bill S. 2296. The purpose of this addition is to manage how the United States protects its AI technology from certain foreign adversaries while promoting the export of U.S. AI systems to allies.

The amendment adds three main focuses to the bill:

Technology Transfer Protections

  • It requires the Secretary of State to assess how well current measures protect technology in areas like research and higher education.
  • It calls for a Technology Diplomacy Strategic Plan for an Artificial Intelligence Global Alliance to encourage U.S. allies to use similar AI protections and export controls.
  • It requires an evaluation of existing export control frameworks to find gaps that might allow AI systems to reach covered foreign countries, which include China, Russia, Iran, North Korea, Cuba, and Venezuela.

Promotion of U.S. AI Exports

  • The Secretary of State must provide regular reports on where U.S. AI systems are being promoted and how they are financed.
  • It focuses on using diplomacy to increase demand for U.S. AI and helping partner countries create environments that support these systems.
  • It requires monitoring these exports to prevent them from being used for surveillance, cyber threats, or nefarious information operations.

Security and Oversight

  • The amendment establishes security standards for export packages, such as prohibiting integration with military infrastructure linked to covered foreign countries and requiring "Know-Your-Customer" protocols.
  • It mandates that the Secretary of State notify Congress about any AI export transactions that exceed $20,000,000 or involve dual-use systems with national security implications.
