What this amendment would do
This amendment, submitted by Mr. Risch, aims to change how the Arms Export Control Act handles congressional notifications.
Changes to Dollar Thresholds The amendment increases various dollar amount thresholds across multiple sections of the Act. It also adds a new section to ensure these amounts are adjusted every three years based on the Consumer Price Index for All Urban Consumers.
Changes to Information Reporting The amendment adds requirements for certifications regarding foreign military sales and direct commercial sales. These certifications must now include information provided by the Department of Defense to the House and Senate Committees on Armed Services, specifically regarding:
- Security cooperation requirements.
- Defense capability gaps.
New Briefing Requirements The amendment adds a requirement for the Secretary of State and the Secretary of Defense to brief the Senate Committee on Foreign Relations at least quarterly. These briefings must cover licenses to export or letters of offers to sell defense services or articles that did not require a certification to be submitted to Congress.
