What this amendment would do

SA 3611 is an amendment proposed by Mr. Rounds to be added to bill S. 2296. Its purpose is to exempt defense readiness activities from certain requirements of title I of the National Environmental Policy Act of 1969.

Specifically, the amendment aims to change the bill by adding a section that:

  • Stops the requirement for environmental documents, such as environmental impact statements or assessments, to be prepared for defense readiness activities.

  • Directs the Secretary of Defense and the Secretary of Energy to identify these exempt activities and establish monitoring measures to reduce adverse environmental impacts.

  • Requires the Secretary of Defense and the Secretary of Energy to notify congressional defense committees about the activities identified and any subsequent revisions.

  • Defines defense readiness activity to include:

    • Computing infrastructure, such as artificial intelligence and data centers.
    • Energy generation on Department of Defense or Department of Energy land.
    • Specific radial lines used for energy interconnection.
    • Installation energy resilience projects.
  • Clarifies that this exemption does not limit other laws, including the Clean Air Act, the Clean Water Act, the Endangered Species Act of 1973, and the Migratory Bird Treaty Act, among others.
