What this amendment would do
SA 3600, submitted by Mr. Hickenlooper and Mr. Crapo, aims to add limitations to the authority for transferring space functions from the Air National Guard to the Space Force. It does this by amending section 514 of the National Defense Authorization Act for Fiscal Year 2025.
The amendment seeks to change or add the following:
-
Transfer Restrictions: It specifies that nothing in the section authorizes the transfer of Air National Guard members except on a one-time, voluntary basis. It also states that no future precedent is established for waiving specific provisions of section 104 of title 32 or section 18238 of title 10 of the United States Code.
-
Legal Compliance: It requires all future force structure changes to National Guards of various States to be conducted according to section 104 of title 32 and section 18238 of title 10 of the United States Code.
-
Consultation Requirements: The transfer cannot happen until the Secretary of the Air Force does the following:
- Engages in sustained consultation with Governors of affected States.
- Submits a report on findings and recommendations regarding the transfer of units and voluntary personnel to the Senate and House Committees on Armed Services.
- Includes direct comments and recommendations in the report from the affected States' Adjutants General.
-
Definition of Consultation: Sustained consultation is defined as at least two meetings with affected State Governors and Adjutants General, along with any other actions the Secretary of the Air Force deems necessary and relevant.
