What this amendment would do

The Safer Supervision Act of 2025 is an amendment proposed by Mr. Coons to be added to bill S. 2296. Its purpose is to change how federal supervised release is handled to reduce burdens on taxpayers and law enforcement, improve public safety, and help defendants with rehabilitation and reintegration.

The amendment aims to add the following to the bill:

  • Judicial Discretion: It requires courts to make an individualized assessment to determine if supervised release is appropriate and to provide the reasons for their decision on the record. It also allows courts to impose supervised release terms shorter than mandatory minimums for certain drug offenses or not impose them at all.

  • Early Termination: It establishes a presumption of early termination if a defendant has demonstrated good conduct and compliance, and if public safety is not jeopardized. This applies after a defendant has served 50 percent of their term (or 66.6 percent for specific offenses described in section 16). It also requires the Administrative Office of the United States Courts to notify eligible defendants of their opportunity to seek early termination.

  • Prisoner Release: It allows the Director of the Bureau of Prisons to release a prisoner up to 12 months early based on time credits if the court did not impose supervised release.

  • Officer Support: It requires a legislative proposal to provide law enforcement availability pay to Federal probation and pre-trial services officers.

  • Accountability and Study: It mandates a GAO report to study federal post-release supervision, reentry services, officer caseloads, and the funding formulas for probation offices.
