What this amendment would do

SA 3563, submitted by Mr. Johnson, aims to add a new section (SEC. 1248) to bill S. 2296. The purpose of this amendment is to make Taiwan eligible for the strategic trade authorization exception regarding certain export control licensing requirements.

The amendment adds the following to the bill:

  • Findings: It notes that Taiwan has high export control standards, adheres to several international regimes (such as the Nuclear Suppliers Group and the Wassenaar Arrangement), and has been treated as a major non-NATO ally.

  • Presidential Action: The President is directed to take steps so Taiwan can be treated as eligible for the exception under section 740.20(c)(1) of the Export Administration Regulations for exporting, re-exporting, or transferring items subject to those controls.

  • Criteria: Before this eligibility is granted, the President must ensure Taiwan meets the usual criteria for the Country Group A:5 list, specifically focusing on how Taiwan's export control policies align with those of the United States.
