What this amendment would do

This amendment, submitted by Mr. Cornyn, aims to change the requirements and rules for the Sponsor's Affidavit of Support within the Immigration and Nationality Act.

The purpose of these changes includes:

  • Increasing Income Requirements: It raises the income threshold for affidavits of support from 125 percent to 150 percent of the Federal poverty line.

  • Updating Termination Rules: It defines specific events that automatically end a sponsor's obligations, such as the alien becoming a U.S. citizen, passing away, or working 40 qualifying quarters of coverage without receiving Federal means-tested public benefits.

  • Adding Protections for Sponsors: It prevents a sponsored alien from enforcing an affidavit of support if they have a final order of removal or have been charged with or convicted of specific crimes (such as sex offenses, trafficking, child abuse, or murder) where the sponsor or the sponsor's child was the victim.

  • Clarifying Joint Sponsors: It provides a detailed definition and requirements for a joint sponsor, who must be at least 18 years old, a U.S. citizen, national, or permanent resident, and be willing to accept joint and several liability.

  • Administrative Changes: It assigns more responsibility to the Secretary of Homeland Security regarding the maintenance of automated systems and the processing of information via the SAVE system.
