SA 3559, submitted by Mr. Cornyn, aims to change the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008 regarding the placement of unaccompanied alien children.
The purpose of this amendment is to prohibit the Secretary of Health and Human Services from placing an unaccompanied alien child in the custody of any individual, or any adult living in the household of an individual, who has been charged with or convicted of the following:
- A sex offense.
- Severe forms of trafficking in persons.
- A crime of domestic violence.
- A crime of child abuse and neglect.
- Murder, manslaughter, or an attempt to commit murder or manslaughter.
- A crime involving sexual exploitation and other abuse of children.
Additionally, the amendment adds a requirement that before a child is placed with any individual, the Secretary of Health and Human Services must require fingerprinting and conduct background checks for the individual and all adult residents living in that household.
