What this amendment would do

SA 3538 is an amendment to bill S. 2296, which deals with appropriations for fiscal year 2026 regarding the Department of Defense, military construction, and defense activities of the Department of Energy.

The purpose of this amendment is to add Section 881, which limits the procurement of cut flowers and cut greens.

  • Procurement Limits: The Department of Defense can only use its funds to buy cut flowers or cut greens if they are grown in a qualifying area (a State, the District of Columbia, a U.S. territory or possession, or an area under the jurisdiction of a federally recognized Indian Tribe). This applies to procurements made in the United States starting 1 year after the Act is enacted.

  • Gifts for Display: The Department of Defense can only accept gifts of cut flowers or cut greens not grown in a qualifying area from a covered entity (a foreign government or an agent of a foreign principal) if:

  • The origin is clearly displayed upon delivery.

  • The Department of Defense also buys a cut flower or cut green grown in a qualifying area to display at the same time.

  • The origin of the gift remains clearly displayed throughout the period it is shown.
