What this amendment would do

SA 3527, submitted by Ms. Warren, aims to add a new section (SEC. 350) to bill S. 2296. This addition creates limitations on using Department of Defense installations to hold aliens.

To use an installation for holding aliens, the Secretary of a military department must, within seven days of starting the operation:

  • Certify to the Senate and House Committees on Armed Services that the operation does not undermine the budget, readiness, or morale of the Department of Defense.
  • Provide a detailed explanation for the certification and why the installation is involved.
  • Make the certification and explanation public.

The amendment also adds requirements for the Secretary of Defense at any installation holding aliens:

  • Maintain a record locator system updated every 24 hours with the alien's location, date of custody, age, and gender.
  • Uphold U.S. Immigration and Customs Enforcement detention standards, including providing the same or more access to phone calls and visitation for family, legal assistants, and legal representatives.
  • Arrange monthly inspections by the Department of Defense Office of Inspector General or another independent watchdog with access to records, aliens, and all parts of the installation.
  • Train personnel on the Standing Rules for the Use of Force, restrictions on civilian law enforcement activities, and other restrictions on interacting with held aliens.

Finally, the amendment allows any State or individual harmed by a violation of this section to seek injunctive relief in a U.S. district court.
