What this amendment would do
This amendment, submitted by Mr. Lankford, aims to add a new section (SEC. 1067) to the bill to authorize the Electronic Visa Update System (EVUS). The purpose is to require certain nonimmigrant visa holders to provide updated biographical and travel information to the Secretary of Homeland Security.
The amendment proposes the following changes and additions:
- System Operation: It authorizes the Secretary to maintain the system to collect information from designated aliens.
- Designations: It allows the Secretary to designate specific nonimmigrant categories and countries for participation based on criteria such as visa overstay rates, visa refusal rates, and national security or public safety interests.
- Compliance Requirements: Designated aliens must enroll in the system within 5 days of visa issuance and provide updates at least every 180 days, or more often if requested due to national security or new derogatory information.
- Enforcement: The Secretary is authorized to revoke the visa of any designated alien who fails to comply, submits fraudulent information, or overstays their authorized period of stay.
- Fees: It establishes a fee for using the system, which must be at least $10.00, and creates a separate Electronic Visa Update System Account in the Treasury to handle these funds.
- Accountability: The Secretary must submit an initial report within 30 days and annual reports thereafter to specific congressional committees regarding compliance, noncompliance, and visa revocations.
