What this amendment would do
Mr. Lankford submitted SA 3477 to add a new section to the Homeland Security Act of 2002. This amendment aims to create the Early Migration Alert Program (EMAP) within the Department.
The purpose of this program is to:
- Lead the dissemination of information about the movement and release of aliens into the United States.
- Create formal partnerships with regional stakeholders to integrate, analyze, and share that information.
To do this, the Secretary, in consultation with the Secretary of Health and Human Services and acting through the Director of U.S. Immigration and Customs Enforcement and the Commissioner of U.S. Customs and Border Protection, must provide specific information to State, local, Tribal, and territorial government personnel at least 24 hours before an alien is released. This information includes:
- The number of aliens being released.
- The number of those aliens with known criminal histories.
- Initial and final destinations where the aliens intend to settle.
The amendment also requires the development of an electronic mail notification system to deliver this information to verified official government email addresses.
The program is authorized to receive $400,000 for fiscal years 2026 and 2027. It would apply to any alien apprehended or released on or after the date the section is enacted.
