What this amendment would do
SA 3475, submitted by Mr. Lankford, aims to add a new section to bill S. 2296 titled "GUIDANCE CLARITY STATEMENT REQUIRED."
The purpose of this amendment is to require agencies to include a specific statement on any guidance issued under section 553(b)(4)(A) of title 5, United States Code.
- This statement must be placed prominently on the first page.
- The statement must specify that the document does not have the force and effect of law and does not bind the public or the agency, but is instead intended to provide clarity regarding agency policies or existing law requirements.
The amendment also requires the Director of the Office of Management and Budget to issue implementation guidance within 90 days after the Act is enacted. Agencies must follow these requirements starting 30 days after that OMB guidance is issued.
