What this amendment would do

SA 3470, submitted by Mr. Lankford, aims to add a section regarding OMB Guidance to bill S. 2296. The purpose is to require the Director of the Office of Management and Budget to create guidance for covered agencies to develop internal control plans that can be used immediately during future crises or emergencies.

  • Guidance Requirements: The Director must issue guidance within 180 days of enactment. This guidance must align with Government Accountability Office frameworks for managing fraud risks and improper payments in federal programs and emergency assistance. It must also require agencies to name a senior official who is accountable for the plan and establish procedures to assess and respond to fraud and improper payment risks when supplemental funds are provided for public health or disaster relief.

  • Review and Submission: The Director must review the guidance every 3 years. Covered agencies must submit their plans to the Director within 1 year of enactment and revise them every 3 years. The Director must then submit these plans to Congress and specific House and Senate committees annually.

  • Limitations: The amendment states that no additional funds are authorized to carry out this section and that actions or omissions by the Director or agency heads under this section are not subject to judicial review.
