What this amendment would do
SA 3407 is an amendment to bill S. 2296. Its purpose is to add a new section, SEC. 1067, which focuses on the REVOCATION OF SECURITY CLEARANCES FOR CERTAIN PERSONS.
The amendment aims to add a requirement that the Secretary of Defense must suspend or revoke the security clearance or eligibility for classified information for retired or separated members of the Armed Forces or civilian Department of Defense employees who engage in lobbying activities or lobbying contacts for specific entities.
These entities include:
- Companies identified by the Secretary of Defense as Chinese military companies under section 1260H of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021.
- Companies on the Non-SDN Chinese Military-Industrial Complex Companies List from the Department of the Treasury.
- Agencies or instrumentalities of the entities mentioned above.
- Entities owned or controlled by an agency or instrumentality of the entities mentioned above.
The Secretary of Defense can waive this prohibition for up to 180 days if they certify to congressional defense committees that it is in the national security interest of the United States.
