What this amendment would do

SA 3383, submitted by Mr. Grassley and Ms. Hassan, aims to change how information is shared regarding suspected violations of intellectual property rights by amending Section 628A of the Tariff Act of 1930.

The amendment intends to make the following changes:

  • Change the wording from "suspects" to "has a reasonable suspicion".

  • Add "packing materials, shipping containers," after "its packaging" where it appears.

  • Allow the provision of nonpublic information about merchandise to the person if that information was:

    • Generated by an express consignment operator, a freight forwarder, an online marketplace or other similar market platform, or any other entity involved in the sale or importation of merchandise into the United States or the facilitation of such sale or importation.
    • Provided to, shared with, or obtained by U.S. Customs and Border Protection.
  • Allow information to be shared with any other party with an interest in the merchandise, as determined appropriate by the Commissioner.
