What this amendment would do
SA 3353, submitted by Mr. Merkley, aims to add Section 1067 to bill S. 2296. The purpose of this addition is to stop current or former government officials from entering the United States if they are found responsible for or complicit in the forced return of certain people to the People's Republic of China.
The amendment seeks to change the law by:
-
Denying Entry: Preventing the Secretary of State from issuing visas and stopping the Attorney General or Secretary of Homeland Security from admitting or granting immigration benefits to officials involved in the forced repatriation of Uyghurs or other ethnic or religious groups likely to face persecution by the Government of the People's Republic of China.
-
Applying Sanctions: Requiring the Secretary to refer these officials to the Office of Foreign Assets Control to decide if their U.S. financial transactions and property should be blocked.
-
Allowing Waivers: Giving the Secretary of State the power to waive these restrictions if it is in the national interest of the United States or if circumstances have changed.
-
Ensuring Accountability: Requiring the Secretary of State to report to specific House and Senate committees every 180 days on who was denied entry and which waivers were granted.
This section is designed to terminate 5 years after the Act is enacted.
