What this amendment would do

SA 3315, submitted by Mr. Lee, aims to add a new section to bill S. 2296 that prohibits the use of military force against the Russian Federation.

The amendment intends to change the bill by adding the following:

  • Authorization and Funding: It states that no law enacted before this Act authorizes military force against the Russian Federation. It prohibits the use of Federal funds for such force unless Congress declares war, there is specific statutory authorization meeting War Powers Resolution requirements, or a commander-in-chief exception under section 2(c) of the War Powers Resolution applies.

  • Rules of Construction: The text clarifies that it does not authorize the use of military force, relieve the executive branch of War Powers Resolution requirements, or prevent the President from using force to defend allies and partners if Congress provides specific statutory authorization.

  • Definition of Military Force: The amendment defines military force to include:

  • Sharing intelligence with Ukraine to enable offensive strikes against the Russian Federation.

  • Providing logistical support to Ukraine for offensive strikes against the Russian Federation.

  • Any use of lethal or potentially lethal force by United States forces against Russian forces, regardless of the domain, whether remote or intermittent.

The definition of military force does not include activities under section 503 of the National Security Act of 1947.
