What this amendment would do
SA 3297, submitted by Mr. Lee and Mr. Curtis, aims to create an exception to the prohibition on constructing naval vessels in foreign shipyards.
The amendment seeks to change Section 8679 of title 10, United States Code, to allow construction in foreign shipyards if the following conditions are met:
-
The shipyard is in a North Atlantic Treaty Organization member country or a country in the Indo-Pacific Region that has a mutual defense treaty with the United States.
-
The cost of construction is less than the cost would be if the construction happened in a domestic shipyard.
Additionally, the amendment adds a requirement that the Secretary of the Navy must certify to Congress that the foreign shipyard is not owned or operated by:
-
A Chinese company.
-
A multinational company domiciled in the People's Republic of China.
