S.Amdt. 3296

SA 3296, submitted by Mr. Lee and Mr. Curtis, aims to change the bill S. 2296, which handles authorizations for military activities, construction, and energy activities for fiscal year 2026.

The purpose of this amendment is to add an exception to the requirements for how proceeds from leases are deposited and used. Specifically, it adds a new clause to Section 2667(e)(1)(B) of title 10, United States Code, regarding:

• In-kind consideration accepted for a lease.
• This consideration must be held in a Federally-insured deposit account owned by a State or a political subdivision of a State.
• The State or political subdivision must act as a trustee for the account.
• There must be a fiduciary duty to the United States.
• The terms must be approved by the Secretary.
