What this amendment would do

SA 3294, submitted by Mr. LEE, is an amendment to bill S. 2296. This bill authorizes appropriations for fiscal year 2026 regarding military activities of the Department of Defense, military construction, and defense activities of the Department of Energy, while also prescribing military personnel strengths.

The purpose of this amendment is to add Section 1038, which creates a limitation on the appointment of retired members of the Armed Forces to certain positions within the Department of Defense.

Specifically, it aims to change Section 3326 of title 5, United States Code by:

  • Updating the section heading and table of sections to include the word "certain" before "positions".

  • Changing the language in subsection (b) to specify that the limitation applies to those appointed to a position in the excepted or competitive service classified at or above GS-14 of the General Schedule (or equivalent) in or under the Department of Defense.

  • Striking specific language in paragraph (1) that begins with "for the purpose" and ends with "Management".
