What this amendment would do
SA 3287, submitted by Mr. Moran and Mr. Warnock, aims to improve benefits for surviving spouses who remarry. It proposes changes to bill S. 2296.
The amendment intends to change or add the following:
-
Survivor Benefit Plan: It amends Section 1450 of title 10, United States Code, regarding the continued eligibility for the Survivor Benefit Plan for surviving spouses who remarry. This includes removing references to remarriage before age 55. It states that if a surviving or former spouse remarries and is entitled to an annuity based on that subsequent marriage when it ends, they must choose which annuity to receive.
-
TRICARE Program: It amends Section 1072(2) of title 10, United States Code, to expand the definition of a dependent. It adds a remarried widow or widower to this definition if their subsequent marriage ended because of annulment, divorce, or death.
