What this amendment would do
This amendment, proposed by Ms. Klobuchar and Mr. Cruz, aims to add a new section to the bill titled "Protecting Covered Information in Public Records." Its primary purpose is to restrict the public disclosure and sale of private, sensitive information belonging to "at-risk individuals."
The amendment seeks to change the current landscape by adding the following protections:
-
Protection of Personal Data: It defines "covered information" as sensitive data such as home addresses, personal phone numbers, personal emails, social security numbers, bank account details, and precise geolocation data.
-
Restrictions on Government Agencies: It allows "at-risk individuals" (which includes Members of Congress, their immediate family members, and certain designated employees) to request that government agencies mark their covered information as private. Agencies must remove such information from public content within 72 hours of a request.
-
Restrictions on Data Brokers and Businesses: It makes it unlawful for data brokers to knowingly sell or purchase covered information of at-risk individuals. Other businesses must remove this information from the internet within 72 hours upon written request.
-
Enforcement: It allows at-risk individuals to seek injunctive or declaratory relief in court if their covered information is made public in violation of these rules.
-
Exceptions: The amendment does not apply to information required by law (such as FEC filings), information used for news-gathering on matters of public concern, or information the individual voluntarily publishes on the internet.
