What this amendment would do
This amendment, called the Deterring Adversary Ill-Gotten Gains Act, aims to add a new subtitle to the bill regarding the seizure and forfeiture of assets of Russian kleptocrats.
The purpose of this amendment is to:
-
Allow for nonjudicial civil forfeiture of property that is eligible for forfeiture under title 18, United States Code, provided the Attorney General or a designee certifies the property.
-
Expand the types of forfeited property available to fix harms to Ukraine caused by Russian aggression. This includes property belonged to, possessed by, or controlled by people whose interests were blocked under the International Emergency Economic Powers Act or other laws related to the Russian Federation or actions threatening Ukraine.
-
Include property involved in violations of export restrictions or conspiracies related to the Russian Federation, Belarus, the Crimea region of Ukraine, or the so-called Donetsk People's Republic or Luhansk People's Republic regions of Ukraine.
-
Extend the authority of section 1708(d) of the Additional Ukraine Supplemental Appropriations Act, 2023, to a date 3 years after this Act is enacted.
-
Allow the Attorney General and the Secretary of the Treasury to create regulations to carry out these rules.
-
Establish that these provisions terminate 3 years after enactment, though this does not affect property already seized or pending legal actions.
