What this amendment would do
SA 3259, submitted by Mr. Tuberville, aims to change the definition of a small business concern owned and controlled by service-disabled veterans within the Small Business Act.
The purpose of this amendment is to allow a small business to keep its status if the death of a service-disabled veteran owner causes the business to be less than 51 percent owned by service-disabled veterans. This applies if:
- A surviving child (defined as a biological or legally adopted child) acquires the deceased veteran's ownership interest.
- The business was in the database described in section 36 before the death and remains there during the specified time period.
The amendment adds a specific time period for this inclusion, which begins on the date of the veteran's death and ends on the earlier of:
- The date the surviving child gives up an ownership interest in the business.
- Three years after the date of the veteran's death.
- 7/31/2025
