What this amendment would do

SA 3222 aims to add a new section, SEC. 1067, to the bill. Its purpose is to require the Secretary of the Interior to track and report on critical mineral and rare earth element resources globally.

The amendment seeks to add the following requirements to the bill:

  • Regular Reporting: The Secretary of the Interior must submit a report to Congress every two years. This report must assess who controls these resources, including whether they are held by a foreign entity of concern or by the United States and its allies.

  • Mine Details: The report must include data on specific mines, such as estimated output, remaining volumes, the entities operating them, and the ultimate beneficial owners.

  • Foreign Influence: The amendment requires lists of foreign entities of concern involved in mining, as well as cases where entities were forced to divest stock or where operations were taken over by a covered nation.

  • Divestment Process: The Secretary must create a process where a United States person can notify the government of their intent to divest stock in foreign mining, processing, or recycling operations. The Secretary may then help them find a purchaser not controlled by a covered nation.

  • Technology Strategy: The Secretary must develop a strategy and a method for sharing intellectual property regarding advanced mining, refining, separation, processing, and recycling technologies with United States allies and partners.
